Krispy Kreme’s data breach settlement is entering its final stretch, and eligible victims have only weeks left to claim cash payments tied to the 2024 cyberattack.
The $1.6 million class-action settlement stems from a November 2024 data breach that exposed sensitive information belonging to more than 161,000 current and former employees. The compromised information allegedly included names, dates of birth, Social Security numbers, biometric data, and financial account details.
While Krispy Kreme denies wrongdoing or liability, the company agreed to settle the lawsuit to avoid prolonged litigation.
Who qualifies for the settlement
According to the official settlement website, eligible class members are US residents who received notice that their personal information “may have been impacted in the Data Incident.”
The settlement FAQs page says the lawsuit was filed after an incident “discovered on November 29, 2024,” involving “the unauthorized access to or acquisition of Settlement Class Members’ Private Information.”
People excluded from the settlement include Krispy Kreme executives, officers, affiliated entities, governmental agencies, and anyone who opts out before the deadline.
How much money could eligible victims receive?
Eligible class members can choose between two payment options.
Those who experienced fraud or identity theft connected to the breach may claim reimbursement of up to $3,500, though documentation is required. Acceptable proof may include receipts, emails, phone records, or other records tied to financial losses.
Alternatively, class members can request a flat cash payment estimated at $75 without submitting supporting documents. The settlement administrator noted that final payment amounts could increase or decrease depending on the number of valid claims filed.
In addition to cash compensation, affected individuals are eligible for one year of credit monitoring and identity theft protection services. The settlement website states that class members should have received activation codes through postcard notices mailed on March 25, 2026.
Important deadlines to know
The deadline to file a claim online or by mail is June 22, 2026. Anyone wishing to exclude themselves from the settlement or object to its terms must do so by June 6, 2026. The final approval hearing is scheduled for July 6, 2026, before Judge Max O. Cogburn Jr. in Charlotte, North Carolina.
How to file a claim
Eligible class members can submit claims online through the settlement website or mail completed forms to the settlement administrator in Portland, Oregon. People who believe they were affected but did not receive a notice can contact the settlement administrator by phone at 1-877-239-1879 for assistance.
Settlement payments and benefits will be distributed only after final court approval and resolution of any appeals.
